Federal Judge Mandates Freedom of Kilmar Abrego Garcia from ICE Detention

A court has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement lacks lawful basis.

"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her ruling.

The case stems from a mistaken removal to El Salvador in March, which the government later acknowledged was an error. After his repatriation to the United States to face alien smuggling allegations, he was held in federal custody.

In her decision, the judge noted that the government does not have a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."

Context of the Case

The court proceedings involve disputed claims. Whereas the former administration argues that Abrego Garcia is a affiliate of the MS-13 criminal organization, he categorically denies this claim.

He has also pleaded not guilty to the smuggling charges, which are part of a ongoing trial in Tennessee.

Conditions of Release

The court, who was hearing his challenge to removal in a Maryland district court, determined that he must now adhere to the conditions of his release from custody in Tennessee. This order shifts his supervision to the jurisdiction handling his criminal case.
